Sex Offender Risk Levels in Otsego County

A judge assigns a risk level to every sex offender after a hearing. The scoring system considers the offense, use of force, victim age, number of victims, substance involvement, and prior criminal history. Each factor adds points and the total determines the risk level.

Level 1 is low risk. These offenders register for 20 years. Address info is limited to ZIP code. Level 2 is moderate risk. Full address is public. Registration is for life. Level 3 is high risk. Full address is public. Registration is for life. These offenders must also verify their address every 90 days in person.

A judge may also add a designation: sexual predator, sexually violent offender, or predicate sex offender. Any designation means lifetime registration at any risk level. Level 2 offenders without a designation who have been on the registry for at least 30 years may petition for relief under Correction Law Section 168-o. Any offender can petition to have their risk level changed, though the court makes the final decision.

Where Sex Offenders Can Live in Otsego County

New York has no statewide residency buffer zones for sex offenders. Otsego County cannot make its own rules either. The Court of Appeals ruled in People v. Diack that local governments do not have the power to add sex offender residency restrictions because the state has fully taken over that area of law.

The Sexual Assault Reform Act restricts certain offenders from entering or living within 1,000 feet of school grounds when the victim was under 18 or the offender is Level 3. Parole and probation officers can add individual conditions for the offenders they supervise. These may include staying away from parks, playgrounds, or other locations. But these are set on a case-by-case basis and are not blanket county rules.
