Sex Offender Risk Levels in Oneida County

Every sex offender in Oneida County receives a risk level from a judge after a court hearing. The judge uses a scoring system that looks at the offense, use of force or weapons, victim age, number of victims, drug or alcohol involvement, and the offender's criminal record. The total score puts the offender at Level 1, Level 2, or Level 3.

Level 1 means low risk of reoffense. Address info is limited to ZIP code. Registration is 20 years unless a special designation applies. Level 2 means moderate risk. Full address is public. Registration is for life. Level 3 means high risk. Full address is public. Registration is for life. These offenders also must verify their address in person every 90 days.

Judges can add designations on top of the risk level. A sexual predator, sexually violent offender, or predicate sex offender designation triggers lifetime registration even for Level 1 offenders. A Level 2 offender with no designation who has been on the registry at least 30 years can ask the court for relief under Correction Law Section 168-o.

Sex Offender Registration Act in Oneida County

The Sex Offender Registration Act governs how sex offenders are registered and tracked in Oneida County. SORA sits in Correction Law Article 6-C and has been active since January 1996. It requires registration for people convicted of qualifying sex offenses in New York, as well as those with equivalent convictions from other states, the federal system, or the military.

Oneida County Court handles SORA hearings for most cases. The Oneida County District Attorney recommends a risk level to the judge. For offenders leaving prison, the Board of Examiners of Sex Offenders makes its recommendation 60 days before release. The court holds a hearing and sets the level at least 30 days before the person gets out. Probation cases move faster, with the hearing at least 45 days after sentencing.

SORA also covers internet reporting. All offenders must give DCJS their email addresses, screen names, and internet accounts. Changes must be reported within 10 days. Failure to comply with any SORA requirement is a felony.

When a Level 3 offender moves into a neighborhood, the sheriff's office is required to notify schools, daycare providers, places of worship, community centers, and other organizations that serve vulnerable populations. Where Sex Offenders Can Live in Oneida County

There are no statewide residency buffer zones for sex offenders in New York. Oneida County cannot create its own restrictions either. The Court of Appeals ruled in People v. Diack that local governments do not have the authority to pass sex offender residency laws because the state has taken over that area of regulation.

The Sexual Assault Reform Act does limit certain offenders. Those convicted of crimes against victims under 18, or Level 3 offenders, cannot knowingly enter or live within 1,000 feet of school grounds. Offenders on parole or probation may face case-specific conditions. A supervising officer might restrict access to parks, playgrounds, or other locations.
