Sex Offender Risk Levels and SORA in Manhattan
The Manhattan District Attorney's Office handles Sex Offender Registration Act hearings for offenders convicted in New York County. At a SORA hearing, the DA makes a risk level recommendation based on the facts of the case. The judge then scores the offender using a point system that weighs factors like use of force, number of victims, victim age, and prior criminal history.
Risk levels work the same in Manhattan as the rest of the state. Level 1 is low risk with 20-year registration. Level 2 is moderate risk with lifetime registration. Level 3 is high risk with lifetime registration and 90-day in-person address checks. Any offender designated a sexual predator, sexually violent offender, or predicate sex offender registers for life regardless of level.
The Sex Offender Registration Act in Correction Law Article 6-C governs the entire process. It has been in effect since January 1996. For offenders leaving state prison, the Board of Examiners of Sex Offenders makes a recommendation 60 days before release, and the court sets the level at least 30 days before the offender gets out.
