Sex Offender Risk Levels in Chautauqua County

Every sex offender in Chautauqua County receives a risk level from a judge after a court hearing. The court reviews factors such as use of force, victim age, number of victims, and weapon or drug involvement. The risk assessment instrument produces one of three levels. Level 1 is low risk with a 20-year registration period (without a special designation). Level 2 is moderate risk with full address made public. Level 3 is high risk with full address public and 90-day in-person verification required. All Level 2 and Level 3 sex offenders register for life under SORA (Correction Law Article 6-C, Section 168 et seq.).

A court can also designate a sex offender as a sexual predator, sexually violent offender, or predicate sex offender. Any designation triggers lifetime registration regardless of risk level. Chapter 1 of the Laws of 2006 extended registration periods. Before that change, some sex offenders had shorter terms. Now, all Level 1 sex offenders without a designation must register for 20 years. Under Correction Law Section 168-o, a Level 2 sex offender with no designation who has been registered for at least 30 years can petition for relief from further registration duties.
