Risk Levels for Allegany County Sex Offenders

A judge assigns a risk level to every sex offender in Allegany County after a court hearing. The judge scores the offender based on factors like use of force, victim age, number of victims, and whether drugs or weapons were used. The risk assessment instrument produces one of three levels. Two sex offenders convicted of the same offense can receive different risk levels based on case details. This process is required by the Sex Offender Registration Act, codified in Correction Law Article 6-C, Section 168 et seq.

Level 1 means low risk of re-offense. These sex offenders register for 20 years if they have no special designation. Their address is limited to ZIP code in public records. Level 2 means moderate risk. The full address is public. Level 3 means high risk and a threat to public safety. Full address is public. Level 3 sex offenders verify their address every 90 days in person. All Level 2 and Level 3 sex offenders register for life. A court can also designate a sex offender as a sexual predator, sexually violent offender, or predicate sex offender, which triggers lifetime registration regardless of risk level. Under Correction Law Section 168-o, a Level 2 sex offender with no designation who has been registered for at least 30 years can petition the court for relief from further registration.

How Sex Offender Registration Works in Allegany County

Sex offenders convicted in Allegany County register at the time of sentencing. The court certifies the person as a sex offender, registers them, and sends the form to DCJS. DCJS enters the data into the registry and forwards it to the Allegany County Sheriff's Office. For sex offenders going to jail or prison, the Board of Examiners of Sex Offenders receives notification at least 120 days before release. The Board makes a risk level recommendation to the court 60 days before the offender gets out. The jail or prison registers the offender at least 15 days before release and sends the form to DCJS at least 10 days before.

All sex offenders in Allegany County must report any address change within 10 days. They must also report internet accounts, email addresses, and screen names to DCJS under the Electronic Security and Targeting of Online Predators Act. Failure to comply with any registration requirement is an E felony for the first offense and a D felony for later offenses. Non-compliance can also result in revocation of parole or probation. Under Correction Law Section 168-l(8), a missed deadline by any agency does not remove the sex offender's duty to register.
